Disse betingelsene og vilkårene er bindene, om du deltar hos Betway. Ved å delta erkjenner du at du har lest og godkjent disse betingelsene og vilkårene, og anerkjenner at disse betingelsene og vilkårene skal gjelde deg. Dersom du er uenig med noen av disse betingelsene og vilkårene, skal du umiddelbart stoppe ditt bruk av programvaren og fjerne programvaren fra din datamaskin. Definisjoner i disse betingelsene og vilkårene:

“Betway” betyr nettsiden betway.com, samt tilsvarende eller erstattende URL;

“Lukket Kunde Konto “ betyr en konto som har blitt lukket, suspendert eller ekskludert enten av oss eller deg;

“Kunde/n/r/ene/s” betyr en registrert kunde eller en lukket kundekonto;

“Spill” betyr poker, casino og alle andre spillene som tilbys hos Betway (ikke inkludert oddssiden);

“Immateriell eiendom “ betyr varemerker og varenavn, enten de er registrert eller ikke, herunder varemerke-søknader og registrerte varemerker, velviljen som knyttes til slike varemerker og varenavn, domenenavn, oppsett, særpreg og handelsstil inkluderer uten begrensninger som vist på nettsiden; domenenavn registreringer og samtlige variasjoner av disse både nå og i fremtiden; enhver opphavsrett på oppsett, særpreg eller handelsstil, all rett eller lisenser med opphavsrett til å benytte seg av et slikt oppsett, særpreg eller handelsstil, samtlige programvare-koder, arkitekturen av programvare, helhetsinntrykket av programvaren eller hvilken som helst annen immateriell eiendom eid eller lisensiert til oss, i hvert eneste tilfelle over hele verden;

“Delta” og beslektede ord herav, er uten begrensinger, all adferd beskrevet i 4.1.1 til 4.1.8 under, besøkende hos Betway, å spille på samtlige spill, bruk av oddssiden, eller bruk av programvaren på hvilken som helst måte;

“Registrerte kunder” betyr en person som på noen måte har registrert seg og åpnet en konto hos oss;

“Tjenesten” betyr tilgjengeligheten til, og levering av programvaren som gir deg muligheten til å delta;

“Programvaren” betyr programvaren eid eller lisensiert til oss for at du skal kunne delta, eller enhver nedlastbar/flash versjon av programvaren som tilbys hos Betway;

“Oddsen” betyr oddsspill som tilbys hos Betway;

“vi /oss/vår” betyr Sailboats Limited, i alle saker vedrørende oddsen og Gnuf Limited, i alle saker som er knyttet til spillene sammen med (der sammenhengen tillater det) deres holdingsselskaper og tilknyttede selskaper;

“Din jurisdiksjon” betyr den jurisdiksjonen der du er bosatt, residerer eller jobber.

Disse betingelsene og vilkårene blir publisert i en rekke språk for informasjonsformål og enkel tilgang til spillerne. 1. Din deltagelse hos Betway

1.1.3 Deltagelse skjer på eget valg, skjønn og risiko.

1.1.4 Du er selv ansvarlig for å konstatere om det er lovlig å delta i din jurisdiksjon.

1.1.5 Du kan kun delta om det er lovlig innenfor din jurisdiksjon.

1.1.6 Du kan kun delta om er fylt (i) 18 år; eller (ii) den lovlige myndighetsalderen i din jurisdiksjon.

1.1.7 Vi garanterer ikke lovligheten av din deltagelse i henhold til lovgivningen i din jurisdiksjon. Deltagelse kan være ulovlig i enkelte jurisdiksjoner. Du forstår og aksepterer at vi ikke kan gi deg noen juridiske råd eller forsikringer og at du selv er ansvarlig for å kontrollere og følge loven i den jurisdiksjonen som gjelder deg før du registrerer deg hos Betway. Tjenesten er kun rettet mot brukere som ikke er hindret av loven i gjeldene jurisdiksjon fra å gamble over Internett. Vi har ingen hensikt om å gjøre det mulig for deg å bryte loven i din jurisdiksjon. Du representerer, garanterer og samtykker i å sikre at du overholder alle lover, vedtekter og forskrifter i din jurisdiksjon i forhold til ditt bruk av programvaren og tjenesten. 1.1.8 Vi har rett til å be deg om bevis på din identitet og alder som en betingelse for at vi gir deg mulighet til å delta, og på hvilket som helst tidspunkt, for å kunne bekrefte at ingen mindreårige deltar. Vi kan kansellere din konto og utelukke deg fra å delta om bevis på alder ikke er gitt, eller om selskapet mistenker at du er mindreårig. Første gang du ønsker å gjøre et uttak, vil vi kreve at du fremlegger følgende former for identifikasjon:

1.1.8.1 Gjeldene og gyldig pass, førerkort eller ID-kort;

1.1.8.2 Den seneste bankutskriften for bankkontoen du benyttet ved innskudd (vi trenger kun å se navnet og adressen din, vennligst utelat annen informasjon);

1.1.8.3 En kopi av forsiden og baksiden av bankkortet du benyttet deg av for innskudd (vi trenger kun å se det første sifferet og de siste fire sifrene); og

1.1.8.4 Et signert, selvsertifisert brev, der du autoriserer dine innskudd og personlige detaljer som er registrert hos Betway.

1.1.8.5 Utbetaling av alle uttak vil kun bli gjort til en registrert kunde.

1.1.9 Du gir herved oss og våre utpekte agenter, som og når vi trenger det, rett til å bekrefte din identitet og verifisere din rett til å benytte de pengene du satser hos Betway.

*1.2 Dine garantier *

1.2.1 Du garanterer, og vi trer inn i disse betingelsene og vilkårene på grunnlag av disse garantiene, at du:

1.2.1.1 Kan delta lovlig under lovene i din jurisdiksjon;

1.2.1.2 Er ”voksen” med en alder på minst: (i) 18 år; eller har nådd (ii) myndighetsalderen innenfor din jurisdiksjon;

1.2.1.3 Skal ikke la en tredjepart, spesielt men uten begrensning til, mindreårige, direkte eller indirekte bruk av din konto hos Betway, bruke programvaren eller akseptere premier fra oss; plasserte innsatser gjort av en tredjepart vil av oss bli regnet som gyldig og bindene;

1.2.1.4 Ikke er bosatt i USA, Israel, Cuba, Iran, Irak, Elfenbenskysten, Polen, Nord- Korea, Tyrkia, Sør-Afrika, Sudan eller Syria i henhold til punkt 1.1.1

1.2.1.5 Spiller i casinoet på individuell basis, utelukkende for personlig underholdning (dvs. ikke som en del av en klubb, gruppe, på en profesjonell måte eller i samarbeid med andre spillere osv).

1.2.1.6 Har gitt oss dine personlige detaljer som er gyldige, nøyaktige og fullstendige i alle og at du skal informere oss umiddelbart skulle slike detaljer endres;

1.2.1.7 Er den sanne og rettmessig eieren av pengene du satser hos Betway, eller at du på korrekt vis er autorisert til å bruke slike penger til det nevnte formålet;

1.2.1.8 Skal ikke sett inn eller satse penger hos Betway som stammer fra noe som helst slag av ulovlige aktiviteter som omtalt nedenfor i 1.5;

1.2.1.9 SSkal betale alle pengene du skylder oss og i respekt av betalingen skal du ikke kreve tilbakebetaling, nekte, reversere eller annullere noen slike betalinger; og

1.2.1.10 Har lest og forstått disse betingelsene og vilkårene.

*1.3 Avvisning av registrering, samt avregistrering og ekskludering *

1.3.1 Vi kan nekte å registrere deg som spiller, eller velge å avregistrere og ekskludere deg som spiller hos Betway, når som helst og av hvilken som grunn.

1.3.2 Du anerkjenner herved at Betway ikke er forpliktet til å gi deg noen varsel før en beslutning om å nekte, avregistrere eller ekskludere deg, samt ikke forpliktet til å gi deg noen grunn for en slik avgjørelse.

1.3.3 Du kan kun åpne og ha én konto hos Betway. Ytterligere kontoer vil ensidig bli lukket av oss. Alle innsatser og bonusinnsatser på slike kontoer vil annulleres og alle innskudd gjort av deg vil bli refundert til deg, minus 10 % i administrasjonsgebyr. I et tilfelle der en spiller har åpnet flere kontoer på en måte som indikerer klar hensikt om å villede Betway.com om spillerens sanne identitet, skal vi har rett til, etter eget skjønn, å holde tilbake alle skyldige beløp, herunder innskudd.

*1.4 Konsekvenser av avregistrering eller ekskluderinger og lukkede kundekontoer *

1.4.1 Om vi avregistrerer eller ekskluderer deg fra Betway, skal vi har rett til å:

1.4.1.1 Holde tilbake betalinger av omstridte midler til deg, hvorvidt slike omstridte midler er innsatser, innskudd, utbetalinger, bonus innsatser, refundering, gratispenger eller liknende;

1.4.1.2 Ekskludere deg fra alle tjenester og produkter som tilbys av samtlige selskap innenfor vår gruppe;

1.4.1.3 Bestemme hvilke kriterier du skal møte for å etablere en ny konto hos Betway; eller

1.4.1.4 I et tilfelle av svindel, ulovlige handlinger eller liknende misbruk av deg, skal vi ha rett til å gi og overlevere all relevant informasjon om deg til en konsernintern database der slikt svindel/misbruk er bokført. Du gir herved en ugjenkallelig tillatelse til at vi kan gjøre dette etter eget skjønn.

1.4.2 Skulle du be om å få din konto lukket, eller om du ber om å bli ekskludert fra Betway, skal alle ubestridte midler bli overført til deg når innsatser på kontoen din er avgjort. Dersom, etter rimelig og iherdig innsats på å kontakte deg, vi ikke kan sende disse pengene til deg, vil ansvaret falle på deg til å kreve inn disse pengene innenfor en periode av 6 (seks) måneder, fra datoen av din forespørsel. Blir ikke dette gjort, vil kontoen din bli ansett som en inaktiv konto.

1.4.3 Det betales ingen renter på kontobalansen.

1.5 Hvitevasking

1.5.1 Malta har strenge lover om hvitevasking, hvilket kan pålegge oss en obligasjon om å rapportere deg til føderale eller lokale myndigheter innenfor slike jurisdiksjoner om vi vet, mistenker eller har noen grunn til å mistenke at noen av dine transaksjoner, blant andre ting, involverer penger som stammer fra ulovlig virksomhet eller involverer bruk av Betway til å bistå kriminell aktivitet.

1.5.2 Om vi har kjennskap til eller mistanke om ovennevnte i 1.5.1, kan vi:

1.5.2.1 Umiddelbart suspendere, avregistrere eller avslutte din konto hos Betway;

1.5.2.2 Etter eget skjønn, ikke refundere noen midler som holdes på en slik konto til deg;

1.5.2.3 Ekskludere deg fra alle eller deler av tjenesten eller produkter som tilbys av selskapene innenfor vår gruppe; eller

1.5.2.4 Overlevere samtlig informasjon om deg til en konsernintern database som bokfører slikt svindel/misbruk. Du gir herved en ugjenkallelig tillatelse til at vi kan gjøre dette etter eget skjønn

Om vi har kjennskap til eller mistanke om ovennevnte i 1.5.1, kan vi være juridisk bundet til å rapportere deg til de nevnte føderale eller lokale autoriteter, og i disse tilfellene kan vi gjøre dette etter eget skjønn.

1.5.4 For å hjelpe med forebyggelse av hvitevasking:

1.5.4.1 Ingen kontanter skal aksepteres til å finansiere en konto hos Betway; og

1.5.4.2 Dersom du ønsker å gjøre betydelige og/eller eksepsjonelle utbetalinger (individuelle eller samlet), vil du bli pålagt å gi oss enten en faks eller elektroniske kopier av de formene for identifikasjon oppført i seksjon 1.1.8.

1.6 Publisitet

1.6.1 Hvis du, mens du spiller hos Betway, vinner en sum av penger, eller noen annen premie, som vi anser er verdt å reklamere, aksepterer du å gjøre deg tilgjengelig for enhver begivenhet av en slik art arrangert av oss. Vi vil gjøre vårt ytterste for å beskytte ditt privatliv.

1.6.2 Uten å fravike fra den generelle betydningen av klausul 1.6.1 ovenfor, gir du oss herved retten til å bruke ditt fornavn eller brukernavn i enhver publisering av din gevinst nevnt ovenfor.

1.6.3 Vi kan fremlegge visse detaljer som du har gitt oss til en tredjepart, underlagt vårt personvern. Du samtykker til dette og vilkårene i vårt personvern.

*1.7 Aksept av risiko og forpliktelser *

1.7.1 Du er fullstendig klar over at det finnes en risiko for å tape penger i nettspill når du deltar, og du er fullt ansvarlig for slike tap. Du erkjenner og godtar at din deltagelse skjer av egen fri vilje, diskresjon og risiko.

1.7.2 Du er selv ansvarlig for nedskriving, betaling og levering av regnskap til ethvert relevant skattekontor, eller annen myndighet, med hensyn til enhver skatt eller avgift på gevinster som skal betales av deg.

1.7.3 Du samtykker at du ikke skal begå noen gjerninger eller vise noen atferd som skader eller potensielt kan skade vårt omdømme.

2. The Service

2.1. The Service and the Software are provided “as is”. We make no warranty or representation, whether express or implied, in relation to the satisfactory quality, fitness for purpose, completeness or accuracy of the Service or the Software.

2.2 We shall not be liable for computer malfunctions, failure of telecommunications service or Internet connections nor attempts by you to participate in games by methods, means or ways not intended by us.

2.3 We cannot guarantee that the Service will never be faulty but we will correct reported faults as soon as we reasonably can. If a fault occurs you should report the fault by e-mail or in writing to our customer service centre.

2.4 Although we shall take all reasonable measures to ensure that the Software and files are free from computer viruses we cannot and do not guarantee that the Software and files are free of such problems. It is your responsibility to protect your systems and have in place the ability to reinstall any data or programs lost due to a virus.

2.5 We may temporarily suspend the whole or any part of the Service for any reason at our sole discretion. We may, but shall not be obliged to, give you as much notice as is reasonably practicable of such suspension. We will restore the Service, as soon as is reasonably practicable, after such temporary suspension.

2.6 In the event of a system malfunction, all unconfirmed bets are void

2.7 Customer complaints regarding account statements or balances must be made within 14 days of posting on the Betway website. Customer complaints should be sent by Email to support@betway.com. Best efforts will be made to resolve a reported matter promptly. If for some reason you are not satisfied with the resolution of your complaint, you can contact the Malta Lotteries and Gaming Authority (LGA) on complaints@lga.org.mt.

2.8 In accordance with clause 4.2 below, we will not be liable to you for any loss that you may incur as a result of such suspension or delay.

2.9 Bonus Bets cannot be transferred or cashed-in. Bonus Bet Terms and Conditions can be viewed here. You hereby agree to be bound by the aforementioned Bonus Bet Terms and Conditions as if they were specifically incorporated into these terms and conditions.

2.10 With the exception of Progressive Jackpot wins, the maximum withdrawal value per week is €4,000. The remaining amount will be returned to the player’s account until such time that they are eligible for a further withdrawal. This clause will only be applied at the discretion of casino management.

3. Shared Environments

We may impose any limits or conditions that we, in our sole discretion, deem fit on any persons who open or attempt to open accounts at Betway where such accounts originate from environments where computers are or the environment is shared.

4. Indemnity and Limitation of Liability

4.1 You agree to indemnify and hold harmless us, our directors, officers, employees, shareholders, agents and affiliates, our ultimate parent and parent companies and any of our subsidiaries against any and all costs, expenses, liabilities and damages (whether direct, indirect, special, consequential, exemplary or punitive or other) arising from any Participation by you, including without limitation:

4.1.1 Visiting, use or re-use of the Betway website;

4.1.2 Use or re-use of the Betway website by means of telecommunication services;

4.1.3 Use or re-use of any materials at, or obtained from, the Betway website or any other source whatsoever;

4.1.4 Entry to, or use or re-use of the Betway website server;

4.1.5 Facilitating or making a deposit into your account at Betway;

4.1.6 Wagering or gaming at Betway through any delivery mechanism offered;

4.1.7 Acceptance and use of any win or prize at or from Betway; and

4.1.8 Use or re-use of Betway software, by any means or through any medium.

4.2 In no circumstances whatsoever shall we, our directors, officers, employees, shareholders, agents and affiliates, our ultimate parent and parent companies and any of our subsidiaries be liable to you in contract, tort, negligence or otherwise, for any loss or damage howsoever arising from any cause whatsoever, whether direct or indirect, or for any amounts whatsoever (even where we have been notified by you of the possibility of such loss or damage).

5. Promotions and Competitions

5.1 We may, from time to time, offer certain promotions and competitions which may have separate terms, conditions and rules that are competition- or promotion- specific.

5.2 In addition to the above, these terms and conditions shall apply to any competition or promotion.

5.3 In the event and to the extent of a conflict between these terms and conditions and the promotion- or competition- specific terms and conditions, the promotion- or competition- specific terms and conditions shall prevail.

5.4 Betway reserves the right to lower the bonus on offer or exclude any player from participating in any bonus, promotion or freebet at any time, for any reason whatsoever.

6. Sports Betting Rules

6.1 In addition to these Terms and Conditions, the Sports Betting Rules shall apply to you and be binding upon you in respect of your Participation in the Sportsbook.

6.2 You agree to be bound by the Sports Betting Rules, which are hereby incorporated into these Terms and Conditions.

6.3 Betway reserves the right to withhold any and all payments to customers – or declare any bet void – if it suspects that either:

1: The integrity of any sporting match or event has been brought into question
2: Match rigging has occurred
3: Irregular betting, designed to manipulate the pool and/or the price(s) has taken place

6.4 Please note that no Sportsbook freebet awarded to a player can be used in the Live-betting section of the site; it can only be used to bet towards a Pre Game selection.

7. Intellectual Property

7.1 You acknowledge and agree that all right, title and interest in the Intellectual Property is our absolute property or duly licensed to us. Any use of the Intellectual Property without our prior written consent is not permitted. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit, or tamper with the Intellectual Property in any manner whatsoever.

7.2 You acknowledge and agree that the material and content contained within the Betway website is made available for your personal, non-commercial use only. Any other use of such material and content is strictly prohibited.

7.3 We hereby grant you a license to download and use the Software in order to Participate, subject to these Terms and Conditions. All rights in the Software are reserved, and you may use the Software only as licensed to you. The architecture and code of the Software is our valuable trade secret, and you undertake not to disclose any information relating to the architecture or code that you may obtain from downloading or use of the software. You agree that we may from time to time use a cookie on your disk to save information (such as user name, password, other personal details, email address) so you do not have to re-enter this information each time you visit Betway. This cookie cannot be used to run programs or deliver viruses to your computer, and is uniquely assigned to you. It can only be read by a web server in the domain that issued the cookie to you. The primary purpose of the cookie is to enable you to save time, and facilitate future access to the site.

8. Termination

8.1 These Terms and Conditions shall come into force immediately upon your marking the box labeled “Yes, I agree to the Terms and Conditions and that I am not resident in the US or Israel” as part of the registration process and shall continue in force unless and until terminated in accordance with its terms.

8.2 We may terminate these Terms and Conditions with respect to you and your account (including your username and password) immediately without notice:

8.2.1 If for any reason we decide to discontinue to provide the Service;

8.2.2 If we believe that you have breached these Terms and Conditions or the Rules;

8.2.3 If your Participation has been in any way improper or breaches the spirit of these Terms and Conditions; or

8.2.4 For any other reason we see fit.

8.3 You may terminate these Terms and Conditions with respect to you and your account (including your username and password) at any time by sending an email to us at support@betway.com, such termination to take effect upon us terminating your account (including username and password), provided that you shall remain responsible for any activity on your account between sending us an email and the termination of your account by us.

8.4 Save as otherwise provided herein, on termination of these Terms and Conditions with respect to you, any balance in your account will be returned to you within a reasonable time of your request, subject always to our right to deduct any amounts owed by you to us.

8.5 On termination of this Agreement you shall:

8.5.1 Discontinue your Participation;

8.5.2 Pay all amounts due and owing to us; and

8.5.3 Remove the Software from your computer equipment and destroy all related documentation in your possession, custody, power or control.

8.6 The right to terminate this Agreement given by this clause shall not prejudice any other right or remedy of either party in respect of the breach concerned (if any) or any other breach.

9. General

9.1 Amendments

9.1.1 We may, without notice to you, amend, alter, delete, interlineate or add to (“Changes”) the Rules at any time whatsoever.

9.1.2 Changes shall become effective, and you shall be bound by Changes, immediately upon their posting on betway.com.

9.1.3 You agree to regularly review the Rules in order to assess whether any Changes have been made.

9.2 Eligibility

Our employees, subsidiaries and affiliates connected to any referral programs linked to Betway, advertising or other agencies, licensees, licensors, distributors and their other associated or affiliated companies or, in the case of individuals, the immediate family of such individual, are not eligible to Participate as a Registered Customer.

9.3 Severability

If any part of the Rules is deemed unlawful, void or for any reason or unenforceable, then that part shall be deemed to be severable from the rest of the Rules and shall not affect the validity and enforceability of the remaining provisions of the Rules. In such cases, the part deemed invalid or unenforceable shall be amended in a manner consistent with applicable law to reflect, as closely as possible, our original intent.

9.4 Non-Waiver

No indulgence granted by us to you should be construed as a waiver of any of our rights in these Terms and Conditions.

9.5 Third Parties

Unless otherwise expressly stated, nothing in these Terms and Conditions shall create or confer any rights on any persons not party to these Terms and Conditions.

9.6 Assignment

We reserve the right to transfer, assign, sub-license or pledge, in whole or in part, any of the rights and obligations granted to or imposed upon us by these Terms and Conditions. You may not transfer, assign, sub-license or pledge any of the rights and obligations granted to or imposed upon you by these Terms and Conditions.

9.7 Whole Agreement

Unless the context otherwise indicates, these Terms and Conditions set out the entire agreement between us and supersede all prior oral or written agreements, arrangements or understandings between you and us. You acknowledge that you are not relying on any representation, agreement, term or condition that is not set out in these Terms and Conditions.

9.8 Interpretation

In these Terms and Conditions the headings are used for convenience only and shall not affect interpretation. References to persons shall include incorporated and unincorporated persons; references to the singular include the plural and vice versa; and references to the masculine include the feminine.

9.10 Applicable Law and Jurisdiction

The validity, construction and performance of these Terms and Conditions shall be governed by Maltese law and shall be subject to the non-exclusive jurisdiction of the Maltese courts to which you and we hereby submit, except that either you or we may seek an interim injunction in any court of competent jurisdiction.

10. Payment Details / Withdrawals

10.1 Identification Checks
Betway reserves the right to ask You for verification documents upon deposits made via credit or debit card and / or prior to executing a withdrawal. This includes, but is not limited to:

• copy of card in question (if applicable)
• copy of photographic identification documents, such as a Passport or Drivers License
• documents confirming residence such as a bank statement or utility bill no older than 3 months.

10.2 Credit Checks
Betway reserves the right to run credit checks on all Cardholders with third party credit agencies on the basis of the information provided on registration.

10.3 Records

10.4 Withdrawals
Any withdrawals that are made by bank wire or cheque will only be payable to the name used when registering with the site and if a debit or credit card has been used to deposit funds the name must correspond to the name registered on the card. There may be charges incurred for withdrawals. Funds must be withdrawn with the same method used for depositing, up to the amount of the deposit. 10.5 Updating Payment Details

PROMOTIONS – TERMS AND CONDITIONS

1. Promotions are valid only for the dates stated on the claim form. Any claims, deposits or play made outside these dates will not be processed.

2. The maximum bonus is limited to the maximum stated on the claim form. 11. Real money wagers are deducted from the Cash Account. If there is no cash available, the wager is deducted from the Bonus Account. Funds in the Bonus Account are only played if there are insufficient credits in the cash balance.

12. Unless stated otherwise all promotions are subject to the Quarantine Rule. The Quarantine Rule states that players are unable to withdraw any amount from their account until they have either met the wagering requirements or played through all funds in the Bonus Account.

13. If a promotion is not subject to the quarantine rule, players may withdraw their funds at any stage. However, any bonus balance remaining in their account will be forfeited and removed from the bonus account.
